In American Gas Association v. Department of Energy, the Court vacated a lower court ruling that had upheld regulations affecting non-condensing appliances. The Trump administration argued that these rules unfairly restricted the sale of certain products and is considering new rulemaking to eliminate them.
Solicitor General John Sauer contended that the Department of Energy cannot adopt standards that effectively remove products with distinct performance characteristics from the market. He stated that the Biden administration’s regulations were flawed both legally and factually. As a result, the case will return to the D.C. court for further review, where judges are expected to reconsider the matter in light of the Supreme Court’s decision.
Republicans have praised the ruling as a major setback for what they describe as federal regulatory overreach. They argue that the Biden administration used environmental policies to influence consumer choices by imposing restrictions on common household products such as furnaces, water heaters, and showerheads. According to supporters of the decision, the ruling protects consumers’ ability to choose the products that best suit their needs.
In a related development, the House of Representatives voted 226–197 to pass the SHOWER Act, legislation aimed at repealing Biden-era restrictions on household showerheads. Supporters say the measure restores consumer choice by allowing each nozzle in a multi-head shower system to be treated as a separate showerhead, increasing available water pressure. Republicans and several Democrats backed the bill, arguing that it represents a commonsense effort to reduce government regulation and give homeowners greater flexibility in their daily lives.
